When someone dies, it may be necessary to file a probate to transfer the person’s assets to the heirs. A probate requires you to file the will, if any, and a petition in the county where the person resided. The process allows for creditors to make claims against the estate and sets a time limit for these claims to be filed. After gathering the assets and paying the debts, a court order will transfer the property to the heirs.
